Delo reports that, according to “unofficial but reliable information”, the Higher Court has rejected the ruling. This means that the Patria case is barred by the statute of limitations and that the judgment is final.
Earlier this year, the Constitutional Court dropped all criminal charges against the three defendants in the Patria case (Janez Janša, Tone Krkovič and Ivan Črnkovič).
It then fell upon Ljubljana District Court Judge Tanja Lombar Jenko, who was assigned to the retrial of the Patria case, to determine whether the case fell under the statute of limitations. The judge had to determine whether the old or the new criminal code applied in the case. She ruled that the old criminal code had be applied, which meant that the case fell under the statute of limitations.
