After the early elections Erjavec was recorded while talking about Prime Minister Miro Cerar and about forming a coalition. The recording was made while waiting for the beginning of a show on Planet TV; where the then editor Bojan Traven, the NSi Party President Ljudmila Novak and her public relation representative were also present, all of them denying recording the conversation.

Erjavec suspects that the conversation was recorded by the NSi representative, but the NSi Party rejects that possibility, claiming that they disapprove all violations of protection of personal data.

Traven denies doing it, arguing that such an act would make it impossible for him to speak with any politician in future.

The DeSUS Party confirmed the filing of the criminal charge.
