The Constitutional Court ruled that different funding programs for primary public and private schools was unconstitutional, since the Constitution declares that primary education is compulsory and is to be financed from public funds.
This provision ensures that all pupils are entitled to free attendance at a state-approved program of primary education, regardless of whether this is carried out by a public or private law entity.
