It is not likely to expect the State Prosecutor's Council to decide on proposal to the National Assembly to relieve the State Prosecutor General. The nine members of the State Prosecutor's Council will at first listen to the defence of Zvonko Fišer, and discuss the contents. It is the first time the State Prosecutor's Council is facing this kind of situation.
The law specifies the conditions or causes allowing a motion to dismiss: failure to perform the cases of the State Prosecutor's Council in compliance with acts, and in due time; interfering with the prosecutor independence, violation of duties or failure to fulfil the annual work program for two consecutive years. The members of the State Prosecution Council must therefore establish whether the corruptive actions Fišer was accused of by the anti-corruption commission comply with any of the conditions for dismissal defined by the law.
The National Assembly will meet on Friday for an extraordinary session to discuss this topic. The session was demanded by the MPs from the SDS and NSi parties.
